SUP Yoga Guernsey (“us”, “we”, “our”) operates SUPYogaGuernsey.com (the “website”) for conducting business for and on behalf of SUP Yoga Guernsey and Chill-Om Holistic.  This Data Processing Notice (“Privacy Policy”) of SUP Yoga Guernsey and Chill-Om Holistic ensures that you are informed about how we collect and use the personal information that you disclose to us when using our website or through our Disclaimer Waiver &/or our Consultation Forms that you complete and sign when accessing any of our services.  Our Privacy Policy it is issued in compliance with the Data Protection (Bailiwick of Guernsey) Law, 2017 “the Law”.

We promise to protect your data, and to manage any information you share with us in line with data protection law. This Notice sets out how and why we collect and use your personal data and our legal basis for doing so.

Who are we?

We are SUP Yoga Guernsey and Chill-Om Holistic.  We are a member of the Federation of Holistic Therapists (“FHT”) (membership no. 136808), and registered Ambassador of the International SUP Yoga Academy (“ISYA”).  We are also registered with The Office of the Data Protection Authority (registration number DPA3931), Guernsey.

What do we do?

SUP Yoga Guernsey offers Stand Up Paddleboarding activities, sessions and events, and Chill-Om Holistic offers Complementary Health Therapies such as holistic body massage, remedial reflexology and Aromatherapy massage. 

Information Collection And Use 

When only visiting our website and submitting your details on our contacts page, we may use your personal information for providing and improving the website and occasionally sending you e-marketing material which we feel may be relevant.  By using our website you agree to the collection and use of information that you provide us in accordance with this policy.  

When accessing or enrolling in any of our services we use your personal information as noted above when only visiting our website and in addition for ascertaining the most suitable complementary health therapy we offer &/or to understand your skillset for SUP Yoga lessons, and monitoring any changes to your healing where applicable, and further improving our level of service to you.

Where does this data come from?

The personal data we process is given to us directly by you, our customers/clients via our website and from the information that you provide when completing and signing our Disclaimer and Waiver for SUP Yoga Guernsey sessions and through the Consultation forms completed from your initial and ongoing treatments.  We do not collect any of your personal data from any other sources.

Our lawful basis for processing your personal data

In order to be able to provide you with the services you require, we use our legal contractual basis for processing your personal data &/or rely on our legitimate business interests.

Consent

In instances where we are not relying on a contractual &/or legitimate business interests’ basis, we rely on consent to lawfully process your personal data.  This can be obtained orally, by email or by an online process.  You have the right to withdraw your consent at any time, however, it must be highlighted that by withdrawing your consent we may not be able to provide you with our core business services.

By submitting a request to a book an activity or appointment you consent to our use of your personal data being securely held for us to comply with our regulating bodies in accordance with our Privacy Policy and Terms and Conditions and note that we may from time to time send marketing in the form of eNewsletters advising you of our activities, classes, or appointments, or other relevant material we feel may be of interest.  

What data do we collect?

When accessing our website and submitting your personal information via our Contacts page we only hold the information that you provide, being your name and email address.  This not only enables us to contact you, our customer to assist you with your enquiry, but also enables us to carry out our core business services &/or comply with a contract, but also to comply with statutory requirements and our legal obligations.

When booking any of our services we only hold the information that you provide us through upon completing a Disclaimer and Waivers for SUP Yoga activities &/or completion of a consultation form for complementary health therapy treatments.  The information we may also hold for complementary health therapy sessions are any relevant updates to your health and healing in between treatments.  

Upon signing such disclaimer and wavier you agree that you are providing us with accurate, current and complete information about yourself, and will promptly notify us if there are any relevant changes to this information including any injuries or other medical conditions and medication(s) which may affect your treatment(s) &/or safe practice or participation during SUP Yoga sessions &/or during complementary health therapy treatments.

We may collect the following information:

  • Your Name

  • Date of Birth

  • Contact information including email address and mobile number

  • Medical information including medication, injuries or surgeries

  • Your appointed next of kin name and their contact number (for SUP Yoga sessions only)

  • Demographic information such as treatment choice(s), class preference and interests

  • Other information relevant to customer surveys and/or offers

  • We also require this information to better understand your needs and thus provide you with a better service, and in particular for the following reasons:

  • Internal record keeping in accordance with health and safety practices, regulation by our governing bodies, and as set out in our Safe Operating Procedures and Risk Assessment (our “SOPRA”);

We may contact you by email, telephone, &/or social media applications such as Messenger or WhatsApp according to the information that you provide us.

By submitting a request to a book an activity, appointment or to purchase a gift certificate you consent to our use of your personal data being securely held for us to comply with our regulating bodies in accordance with our Privacy Policy and Terms and Conditions.

Special category data

Defined in the Law as – “Personal data revealing … health data…”  The Law requires this data to be processed with additional protection.  You provide us with Explicit Consent to process this data upon signing our Disclaimer and Waiver &/or Consultation Form.

Controlling your Personal Information 

We will not share, sell, distribute or lease your personal information with any third parties, nor will we transfer your personal data outside the Bailiwick of Guernsey.  

Retention of data

All data is retained securely and only used for the purposes for which it was collected under the Law in order for us to provide you with the services forming part of our contract or with your consent.

You may freely, without prejudice unsubscribe at any time either orally, or by using the unsubscribe link at the bottom of any eNewsletter, or by notifying us via email at Kristine@SUPYogaGuernsey.com.

Your rights

Under The Data Protection (Bailiwick of Guernsey) Law, 2017 you are provided with a number of rights, but specifically and of relevance, you have the right to:

  • request confirmation of the personal data that we hold about you and what we are doing with your data;

  • request correction of your personal data if incorrect, out of date or incomplete; and

  • request that we stop any consent-based processing of your personal data after you have withdrawn that consent.

If you would like a copy of the information held on you, or if you believe that any information we are holding on you is incorrect or incomplete, please contact us as soon as possible, we will promptly correct any information found to be incorrect.

If you feel that your personal data has been handled incorrectly or you are unhappy with our response to any requests you have made to us regarding the use of your personal data, you have the right to lodge a complaint with ODPA by submitting a complaint online at www.odpa.gg  and complete the ‘make a complaint’ section.
